Just one day before his arrest, the actor celebrated his wife Jessica Rose Lee’s birthday with a loving tribute on Instagram
Tom Welling has had a run-in with the law.
Just after midnight on Sunday, Jan. 26, the Smallville star, 47, was arrested for driving under the influence in Yreka, Calif., according to an arrest and booking report obtained by USA Today.
The actor’s blood alcohol level was at or above the legal alcohol limit at 0.08 percent, police wrote in the report.
He was arrested by a Yreka Police officer and booked into Siskiyou Country Sheriff’s Office custody around 2 a.m. local time, the report says. Hours later, at around 7 a.m., he was released.
An arraignment date, according to USA Today, is scheduled for March 11.

Welling is best known for his portrayal of Superman on The CW’s Smallville, which premiered in 2001.
The series took an unprecedented magnifying look at the hero’s origins over the course of 10 seasons. In fact, Welling’s Clark Kent character didn’t embrace the Superman identity or wear the iconic suit until the series finale, which jumped seven years into Smallville Clark’s future.
Despite its departure from standard Superman imagery, Smallville consistently paid tribute to earlier adaptations. The series featured cameos from franchise alumni, like Welling’s predecessors Christopher Reeve and Dean Cain and previous Lois Lanes Margot Kidder and Amy Adams.
Welling is also known for his roles in Cheaper by the Dozen, Lucifer, Draft Day and more.
The actor’s arrest comes just after he celebrated his wife, Jessica Rose Lee’s birthday on Sunday with a loving tribute shared on Instagram.
The post included photos of the couple riding horses and various shots of Lee smiling.
“Happy Birthday to our Angel who makes our dreams come true and inspires us even more! We love you to the moon and back!” he captioned the post.
Welling and Lee began dating in 2014 and tied the knot in 2019 at a vineyard in Santa Ynez, Calif. They’ve since welcomed two children, sons Thomson Wylde and Rocklin Von.
